By accessing or using any part of this website, or by placing an order with us, you agree to be bound by these Terms. 1. General Conditions & Eligibility

• Business Use: Our products—including intake pads, exhaust rolls, ceiling diffusion media, and related booth accessories—are intended primarily for commercial, industrial, and professional use.

• Age Requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

• Refusal of Service: Paint Booth Maintenance Services, Inc. reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion for any reason at any time.

2. Products, Specifications & Custom Orders

• Product Accuracy: We strive to display product images, dimensions, efficiency ratings (e.g., MERV ratings), and specifications as accurately as possible. However, slight variations may occur based on manufacturer updates or batch processing.

• Custom Cut & Non-Standard Orders: Filters cut to custom dimensions or special-ordered for specific non-standard booth configurations are final sale and non-returnable once production or cutting has commenced.

• Inventory Availability: All products are subject to availability. We reserve the right to limit sales quantities or discontinue products at any time without prior notice.

3. Pricing, Payments & Fee Discounts

• Pricing Adjustments: Prices for our products are subject to change without notice.

• Payment Methods: We accept major credit card transactions (processed securely via PCI-compliant gateways using tokenization), eChecks/ACH, and physical checks or money orders.

• Pay by Check / Cash Discount Price: * Customers selecting the Pay by Check (Cash Discount Price) option agree to pay via physical check, money order, or approved ACH transfer to receive discounted pricing or avoid credit card processing service fees.

  • Orders placed under the Pay by Check method will remain On Hold until physical payment is received, deposited, and verified.

  • Checks must be made payable to Paint Booth Maintenance Services, Inc. and mailed to:

• Sales & Freight Quotes ($2,500+ Orders): Orders exceeding standard freight parameters or bulk orders over $2,500 may require custom freight calculations prior to final shipment release.

4. Shipping, Freight & Delivery

• Fulfillment: Orders are shipped to the address provided at checkout. Please ensure shipping details are accurate before submitting an order.

• Freight Shipments: Large, bulk, or palletized filter shipments delivered via freight carriers must be inspected upon arrival:

  • Bill of Lading (BOL): Any visible outer packaging damage, crushed cartons, or missing items must be explicitly noted on the driver’s Bill of Lading (BOL) prior to signing.

  • Reporting Window: Concealed damage or shipping errors must be reported to us within 48 hours of delivery alongside photos of the damaged goods and shipping labels.

• Shipping Delays: Paint Booth Maintenance Services, Inc. is not liable for carrier delays caused by severe weather, freight congestion, incorrect address details, or labor disruptions.

5. Returns, Refunds & Restocking Fees

Returns and refunds are governed by our official Refund and Returns Policy, which is incorporated into these Terms by reference:

• Return Window: Eligible standard items may be returned within 30 days of delivery.

• Condition: Items must be completely unused, uninstalled, free of shop contaminants/overspray, and in original packaging.

• Restocking Fee & Freight: Approved returns for reasons other than seller error or defective goods are subject to a 15% restocking fee. Original shipping fees are non-refundable, and the buyer is responsible for return freight costs.

6. Intellectual Property

All content included on this site—including product descriptions, logos, site layouts, graphics, icons, images, text, and software—is the property of Paint Booth Maintenance Services, Inc. or its content suppliers and is protected by United States and international copyright laws. Unauthorized reproduction or redistribution is strictly prohibited.

7. Limitation of Liability & Disclaimers

• As-Is Availability: This website and all products delivered to you are provided “as is” and “as available” for your use, without any representation, warranties, or conditions of any kind, either express or implied.

• Proper Installation & Compliance: Customers are strictly responsible for ensuring that chosen filter media comply with local safety codes, EPA regulations, OSHA standards, and booth manufacturer operating specifications.

• Indemnification: In no case shall Paint Booth Maintenance Services, Inc., its directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages (including lost profits or shop downtime) arising from your use of any product or service purchased through the website.

8. User Conduct & Security

You agree not to use the site to:

• Engage in fraudulent checkout practices, carding attacks, or unauthorized automated scripts/bot submissions.

• Transmit viruses, malware, or malicious code designed to disrupt site operations or compromise server security.

• Attempt unauthorized access to restricted site databases, payment gateways, or customer records.

These Terms and Conditions and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
